In April 2018, Governor Cuomo signed a series of new laws aimed at combating sexual harassment in the workplace. These laws included personal liability for public employees, expanding protections to non-employees, additional obligations for state contractors, and restrictions on the use of arbitration clauses and nondisclosure agreements. Most important for employers is the requirement that all employers develop and communicate a sexual harassment prevention policy and provide sexual harassment prevention training to all employees on an annual basis.
- All employers must have distributed a policy meeting minimum standards defined by the State by October 9, 2018.
- All employees must receive training meeting state minimum standards no later than October 9, 2019 with new employees trained “as soon as possible.”
