Description of bills used in the 2015-16 Legislative scorecard

2014 Session - Business Council Supported

  1. Business tax reform

    Modernization and reform of corporate franchise tax; reduction of CFT rate; repeal of AMT; elimination of ENI tax for manufacturers; refundable RPT credit for small manufacturers; and estate tax reform.
  2. Senate Budget Resolution/ Revenue bill
    R.4036 (S.6359-C)
    The Senate resolution supported key TBC tax/assessment reform issues, including expedited repeal of 18-A energy assessments, maintain the ITC, adopt statewide manufacturing credits, and others, that were picked up in the final budget agreement.
  3. FY 2015 Spending Growth

    State operating funds spending growth limited to 1.8%.
  4. Wage theft reform act amendments

    Repeals the annual notice requirement, expands affirmative defenses, and increases civil penalties.
  5. Brownfield program extender

    Extends tax credits through March 2017, increasing certainty to project sponsors.  Also increases superfund bonding authority by $300 million.
  6. Two year extender of procurement provisions

    Extends state contracting rules by two years, through July 31, 2016, allowing time for broader procurement process reform and streamlining.
  7. Small group self-insurance

    Preserves stop loss coverage to preserve self-insurance for groups with 51 to 100 employees.
  8. Life insurance guarantee fund

    Expands the life insurance company guarantee fund, and increase conformance with the NAIC Model Act.
  9. RPT PILOTs for nuclear power plants

    Extends authority for local PILOT agreements with nuclear power plants.
  10. Four year legislative terms

    Adopts four-year legislative terms as means to reduce campaign spending and fundraising, as an alternative to more onerous “reform” proposals that would limit political advocacy.
  11. Legal Counsel for non-party deponents

    The so-called “potted plant” bill, allows a non-party's counsel to participate in a deposition and make objections on behalf of his or her client in the same manner as counsel for a party.
  12. Net Metering Study

    Requires the PSC to perform a study of the economic and environmental benefits and costs associated with the state's net metering laws, in order to gauge the program’s effectiveness.
  13. Sea Rise task force

    Requires consideration future climate risk due to sea level rise, storm surges and flooding, to ensure that state-funded projects consider presumed effects of climate change and extreme weather events.
  14. NYC Joint Bidding of utility interference work

    Allows NYC to include private utility interference work as part of the competitive bid process, resulting in one contract award for all the renovation or installation work.

  1. Fuel Cell Net Metering

    Extends renewable net metering provisions to micro-combined heat and power and fuel cell customer-generators.
  2. Call Center Hearings

    Requires a sixty day notice period and a public hearing in response to any proposal by a gas or electric corporation to close an in state call center.
  3. 5 year moratorium on fracking
    S.4236-B/A.5424-B
    Imposes a moratorium on natural gas extraction in low permeability natural gas pools until May 15, 2015, and requires a skewed health impact study.
  4. State Level TSCA/restrictions for “children’s products”

    Replicates EPA programs by mandating the DEC implement a chemical review process for “children’s products,” and allows for state-level bans and restrictions.
  5. Economy Wide GHG restrictions

    Directs DEC to require GHG emissions reporting from virtually any emission source in the state, and to impose an enforceable limit (no higher than 1990 total emissions) on the aggregate greenhouse gas emissions from all in-state sources.
  6. Paid Family Leave

    Expands the mandatory disability insurance program to cover up to 12 weeks of paid family leave per year; significantly increases maximum weekly disability benefits.
  7. Whistle Blower expansion

    Significantly expands the state’s so-called “whistle-blower” statute, to allow employees to bypass internal compliance programs.
  8. Citizen Utility Board

    Creates a duplicative consumer advocate function within the Department of Public Service, funded by additional utility assessments.
