As you know, pursuant to the 2017 Workers’ Compensation Reform, the Workers’ Compensation Board was tasked with producing a new Impairment Guideline for Scheduled Loss of Use Awards. The first draft of this Guideline was shared with a small group of representatives of business, labor and insurance carriers. With limited time, The Business Council issued comments. On September 1, the Board released draft guidelines (modified since draft #1) and related regulations, which are now available here.

The Business Council will be reviewing the Guidelines in the coming weeks and issuing comments. We encourage all of you to review these documents and provide any additional comments, data and information that you believe would be helpful in shaping these guidelines to create a modern cost-saving program.
