Workers' Compensation Committee Update, February 9, 2010

The Workers' Compensation Board has just released on its web site the draft Medical Treatment Guidelines.

These Guidelines reflect revisions made to the content pursuant to the substantial comment period the Board conducted, which closed in early September 2009. Included with the revised Guidelines is a separate page which details the substantive changes made to the initial draft Guidelines and changes made as a result of reformatting of the documents.

The posting of the revised Medical Treatment Guidelines does not constitute the formal regulatory process which the Board anticipates undertaking "in the near future".

I welcome any feedback Business Council members have on these revised Guidelines. We will continue to push for the Board to move this process from "review" to "regulatory rulemaking" so the Treatment Guidelines can become fully effective in New York's workers' compensation system.
