ACA “Small Group” Change

This week the U.S. Senate and House respectively passed S.1099 / H.R. 1624 Protecting Affordable Coverage for Employees (PACE) Act, bipartisan legislation that keeps the “small group” definition at 50 workers but let states increase the number if they choose. President Obama is expected to sign the bill.

New York’s definition of “small group” has been statutorily change to include businesses with 50-100 employees. At this juncture there is no indication that the State will take action to reverse this change. The Business Council will continue to advocate for measures meant to lower the costs of health care for employers and will continue to keep abreast on any developments.
