State of the State
The Governor in his State of the State Address, available here, spent a relatively limited time on health care. His agenda included improvements in the quality of care in hospitals, with a focus on implementation of best practices to identify and respond to sepsis infections.
While health care issues did not take center stage in the State of the State, we remain focused on our mission to curb the ever-growing cost of health care in New York and continue to advocate for business in the ongoing development of the Healthcare Exchanges.
To that end, we continue to insist that New York State finally empanel the NYS Health Care Quality and Cost Containment Commission, established in statute in 2007, meant to analyze the impact on health-insurance costs of proposed legislative mandates. This Legislative session we will maintain a “Mandate Watch” that will list every bill introduced in the Legislature that would impose new unfunded mandates on private insurance. As of the first day of the 2013 session these include:
A490 Paulin - Enacts "Hannah's law;" requires certain insurance policies to include coverage for the cost of enteral formulas for the treatment of eosinophilic disorders.
A712 Rosenthal - Requires all insurance policies to provide a certain amount of coverage for hearing aids.
A888 Lifton - Provides for health insurance coverage for family members of children who require psychiatric or psychological services.
A941 Kellner - Provides lifetime, premium-free insurance through the Healthy NY program to a person who donates a kidney during the course of his or her lifetime.
A962 Kellner - Provides that persons with clotting protein deficiencies who are otherwise eligible for certain health insurance programs shall have access to reimbursement for certain treatments.
A973 Kellner - Relates to the payment of medical malpractice insurance premiums and creates the health care access protection fund.
A978 Kellner - Requires blanket health insurance policies to provide coverage for outpatient treatment by mental health practitioners.
A1009 Weprin - Provides for increased podiatry care and benefits under accident and health insurance policies.
A1136 Cahill - Provides for eligibility for coverage under the New York State health insurance program for after-adopted children of unremarried spouses of deceased employees.
A1476 Colton - Provides for health insurance coverage for loss or damage to prosthetic limb.
S272 LARKIN - Requires coverage for anesthesia and hospital charges for dental care.
S297 DIAZ - Provides that municipalities must provide substance and alcohol abuse counseling and treatment for police officers.
S541 KENNEDY - Requires health insurers to provide coverage for long term medical care for Lyme disease and other tick borne related pathogens.
S889 PARKER - Provides for health insurance coverage for nutritional care provided through licensed nutritionists.
S1049 MAZIARZ - Requires insurance coverage for craniofacial disorders.
S1580 PARKER - Requires all insurance policies and medical assistance to provide coverage for medically necessary hearing aids for children under 16 years of age.
