DEC Commissioner John Cahill announced today the release of the draft report of the Governor's Superfund Working Group. This working group, appointed last August, was charged with making recommendations on financing and reform issues related to the state's superfund program, oil spill program and voluntary cleanup program. It was also charged with proposing a strategy for dealing with hazardous substance sites that fall outside of the state's existing enforcement and funding programs.
The working group did not reach consensus on the full range of issues addressed in the report. Provisions regarding the application of use-based cleanup standards, requirements for groundwater remediation, and sources of funding were identified as the key open issues in the draft report.
The DEC has established a public comment period on the draft report, and written comments can be submitted until May 24. The administration anticipates introduction of a comprehensive refinancing and reform proposal this session, once the report is finalized.
