DEC Part 375 Revisions

The DEC's long-awaited proposal to revamp Part 375, to include brownfield implementation regulations and brownfield program use based cleanup standards, and to restructure existing provisions regarding the state superfund program, were officially released today.

The State Register notice is available online at: www.dos.state.ny.us/info/register/2005/nov16/pdf/Rules.pdf. (see page 5). This site provides basic information on the proposal, including information on the public hearing schedule and public comment period (which extends to March 27, 2006), and the regulatory impact statement.

In addition, a DEC issued fact sheet on the proposal is provided below.
Review and response to this proposal will be a major project for TBC's Environment Committee. Given the scope of the proposal, the size of the documents, and the extended comment period, we will probably schedule our first work group session in mid-January. In the meantime, we will be working on a summary of the proposal, highlight issues of concern, and will be sharing same with TBC members. I would be interested in receiving any input from you, as you being to review these documents. Also, please let me know if you would like to be on our Part 375 review workgroup.
