Contract Procurement Committee Update

Assemblywoman Destito introduced last evening a procurement lobbying law extender bill, Assembly 9949, which among other provisions, extends the provisions of that act until July 31, 2014.

The legislation includes other changes to the state finance law including:

  • defining that "governmental procurement" shall include the public announcement or communication to any potential vendor of a determination of a need for a procurement, which shall include but not be limited to, the public notice of the specifications;
  • adding to the definition of "procurement contract" the including of an amendment to or an extension, renewal or change order to an existing contract; and the inclusion of contracts governing organ transplants and contracts allowing for state participation in trade shows;
  • more stringent definitions of "offeror;"
  • adding language which requires the designation by governmental entities involved in a procurement to designate personas knowledgeable about the oversight of that procurement who may be contacted by offerors and to adhere to a guiding set of principles in the determination of awards.

I am asking for member feedback on this bill, prior to issuing a memo on it, and also to more fully reflect to Assemblywoman Destito changes the vendor community may wish to see in any contract procurement reform legislation.
