Can I still submit an H1-B visa application
for an employee who I wish to sponsor?
A. On
Friday, October 1, 2004, the United States Citizen and Immigration
Service
announced that it had received sufficient H-1B visa petitions
to exhaust the H- 1B visa quota for Fiscal Year 2005, which
runs from October 1, 2004 to
September 30, 2005. Currently, 65,000 H-1B visas are available
each year.
Unless Congress acts to increase the annual H-1B visa allocation,
no additional
new H-1B visas will be issued for FY2005. The earliest petitions
can be filed for
FY2006 (with a work start date of October 1, 2005) will be
April 1, 2005.
