JULY / AUGUST 2003 HR QUESTION OF THE MONTH

Q. We heard that under the new tougher workplace smoking restrictions effective on July 24, 2003, employees smoking outside near building entrances would have to move at least twenty feet from the doorway entrance so people entering would not have to walk through second-hand smoke. Is this part of the new smoking law?

A. No. The July changes in the smoking law place additional restrictions on indoor workplace smoking. Smoking is still permitted outdoors. However, a private property owner or municipality in the public sector may voluntarily place additional smoking restrictions. As a practical matter, if you have complaints about smokers blocking entrances, you need to deal with them as an employee relations matter.
