Q. We know that care for a newly adopted child is covered under the federal Family Medical Leave Act. What about time for the activities prior to the actual adoption, such as time for the extensive meetings and interviews?

A. The Family Medical Leave 12 week period includes not only care for the child after adoption, but also all process and application activities prior to the actual adoption itself. Keep in mind that employees must generally provide at least 30 days' notice before taking FMLA leave if foreseeable or as soon as possible if not. This means that the employee must provide notice within one or two working days after learning of the need for the leave.
