Q. What
are the particulars of the New York State smoking law?
A.The
New York State Clean Indoor Air Act restricts smoking in the workplace
and requires that an employer post its smoking policy and clearly label
every place where smoking is prohibited or restricted under the act.
Generally, employers must provide
non-smoking employees with a smoke-free workplace. Employers must prohibit
smoking in conference/meeting rooms, elevators, auditoriums, restrooms,
classrooms and hallways and may designate a separate enclosed room
or rooms not open to the public for use as a smoking area. No smoking
areas in lunch rooms must be sufficient to meet employee demand.
An employer may, if it wishes, ban
smoking in the workplace completely.
New York City has a more restrictive
workplace smoking law.
